Terms of service.
The short version: this site explains how we work. Nothing here is a contract, a quote, or a promise of savings. An engagement starts only when both sides sign a written agreement.
1. Agreement
These terms govern your use of elite-logistics.io (the “site”), operated by Balawender & Associates LLC, Ohio, USA, doing business as Elite Logistics (“we,” “us”). By using the site you agree to them. Our privacy policy explains how we handle information.
2. No engagement until a signed agreement
Submitting the discovery form, requesting a call, or sharing freight data does not create a client, advisory, agency, or fiduciary relationship. Any no-cost study, engagement, fees, shared-savings terms, deliverables, confidentiality, and data handling are governed only by a separate written agreement signed by both parties. If that agreement conflicts with these terms, the agreement controls.
3. Informational content — not professional advice
The site is general information about our services and freight practices. It is not legal, tax, accounting, financial, or regulatory-compliance advice. Calculators, lane studies, charts, and figures on the site are illustrative examples, not projections or guarantees of results for your business; your outcomes depend on your freight, carriers, contracts, and market conditions.
4. Using the site
You may use the site to learn about our services and contact us. You agree not to:
- submit false, misleading, or automated inquiries, or impersonate anyone;
- copy, scrape, or republish substantial parts of the site without permission;
- interfere with the site, probe or test its security, or overload it; or
- use the site in violation of any law.
5. What you send us
You confirm that information you submit is accurate and that you are authorized to share it. Please do not send confidential information through the form; we cannot treat unsolicited submissions as confidential unless a written agreement says so.
6. Our content
The site’s text, graphics, logo, and design are owned by Balawender & Associates LLC or its licensors and are protected by intellectual-property laws. You may view and share pages for your own business evaluation. Other uses need our written permission.
7. Trademarks & client logos
“Elite Logistics” and its logo are marks used by Balawender & Associates LLC. Company names and logos shown in “Brands we’ve helped” are trademarks of their respective owners, are shown for identification only, and reflect work performed by our principals, Rob and Nick Balawender, across their careers. Their display does not imply endorsement, sponsorship, or a current relationship.
8. Links to other sites
The site links to other websites, including The Shipper’s Almanac, which is published by the same company, and to third-party sites we do not control. We are not responsible for third-party content or practices.
9. Disclaimers
The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement, and we do not promise the site will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Balawender & Associates LLC and its members and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of or reliance on the site. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars (US$100). This section does not limit anything agreed in a signed engagement agreement. Some jurisdictions do not allow these limits, so they may not fully apply to you.
You agree to indemnify us against claims arising from your misuse of the site or violation of these terms.
11. Governing law
These terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Ohio, and you consent to their jurisdiction. If any part of these terms is unenforceable, the rest remains in effect.
12. Changes
We may update these terms. The new version takes effect when posted here with a new date; continuing to use the site means you accept it.
